Welcome to Clessence.

These Terms of Service (“Terms”) govern your access to and use of the Clessence website, products, subscriptions, promotions, and related services.

Clessence is an independently operated ecommerce business offering products through our Shopify-powered online store. Certain products may be manufactured, stored, packaged, shipped, or otherwise fulfilled by third-party suppliers and fulfillment partners.

Throughout these Terms, “Clessence,” “we,” “us,” and “our” refer to the operator of the Clessence store.

By visiting our website, placing an order, purchasing a subscription, or otherwise using our services, you agree to these Terms together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Subscription/Cancellation Policy.

If you do not agree with these Terms, please do not use our website or purchase our products.

1. Online Store

Our online store is hosted through Shopify, which provides the ecommerce platform that allows us to offer our products and services to customers.

You may not use our website or products for any unlawful, fraudulent, abusive, or unauthorized purpose.

You agree not to interfere with the operation, security, or functionality of our website.

2. Eligibility

You must be legally capable of entering into a binding purchase agreement in your jurisdiction to purchase from Clessence.

By placing an order, you confirm that the information you provide is accurate, complete, and current.

You are responsible for maintaining accurate:

• name and contact information;
• billing information;
• shipping address;
• payment information; and
• account information.

Clessence is not responsible for delivery problems caused by incorrect information supplied by the customer, except where applicable law provides otherwise.

3. Our Products

We make reasonable efforts to accurately display product images, descriptions, ingredients, quantities, packaging, prices, and other information.

Product packaging, labeling, appearance, ingredients, or other characteristics may occasionally change where legally permitted.

Always review the physical product label before use.

If information on the website conflicts with legally required information appearing on the physical product label, customers should follow the product label and contact us with any questions.

4. Clessence 15-in-1 Advanced Eye Formula

Clessence 15-in-1 Advanced Eye Formula is marketed as a dietary or natural health supplement for nutritional and wellness support where legally permitted.

The product is intended to be used according to the directions and warnings appearing on its label.

Clessence does not guarantee that every customer will experience the same results.

Individual experiences may vary based on factors including age, health, diet, lifestyle, medication use, supplement use, and individual physiology.

5. Health and Medical Disclaimer

Information provided through the Clessence website, advertisements, social media, emails, FAQs, product descriptions, and other materials is provided for general informational and wellness purposes.

It is not intended to replace professional medical advice, diagnosis, or treatment.

Clessence products should not be considered a substitute for prescription medication, corrective lenses, medical care, or advice from a qualified healthcare professional.

Do not disregard professional medical advice or delay seeking medical care because of information appearing on our website.

Customers who:

• take prescription medications;
• use other supplements;
• have a medical condition;
• are pregnant or nursing;
• have known allergies or sensitivities; or
• have concerns about whether a product is appropriate for them

should consult an appropriate healthcare professional before use.

Health Canada also advises consumers using natural health products to follow label instructions and discuss potential interactions with healthcare professionals.

6. No Guaranteed Results

Any statements concerning eye wellness, nutritional support, visual function, antioxidant support, or similar benefits are not guarantees that a particular individual will experience a specific outcome.

We do not guarantee:

• improved eyesight;
• restored eyesight;
• elimination of glasses or corrective lenses;
• prevention of eye disease;
• treatment or cure of an eye condition;
• specific results within a particular number of days; or
• identical results for every customer.

7. Orders

Submitting an order does not automatically mean that the order has been accepted.

We reserve the right, where legally permitted, to decline or cancel an order because of:

• suspected fraud;
• payment problems;
• inventory problems;
• incorrect pricing;
• technical errors;
• shipping restrictions;
• regulatory restrictions;
• suspected unauthorized resale; or
• other legitimate business reasons.

If an order is cancelled after payment has been collected, the applicable amount will be refunded.

8. Pricing

Prices are displayed in the currency shown on our website or checkout.

Product prices and promotions may change from time to time.

The price applicable to your purchase is the price disclosed to you before your order is submitted, subject to correction of obvious errors where permitted by law.

Applicable shipping charges, taxes, and other mandatory charges will be disclosed during checkout where required.

Clessence may offer bundle promotions including offers such as:

Specific bundle pricing, quantities, subscription terms, promotional gifts, and shipping benefits will be displayed with the applicable offer.

Bundle promotions may be modified or discontinued for future purchases at any time, subject to applicable law.

Existing completed purchases will not be retroactively changed merely because a later promotion changes.

10. Free Gifts and Promotional Items

Qualifying purchases may include complimentary promotional items such as wellness accessories, organizers, pouches, planners, or other gifts.

Free gifts:

• are subject to availability;
• may be limited to qualifying offers;
• may be available only with an initial purchase unless expressly stated otherwise;
• may be substituted with an item of comparable promotional value where legally permitted; and
• have no cash redemption value unless otherwise required by law.

If an order qualifying for a promotional gift is cancelled or returned, we may require the promotional item to be returned as part of the return where that condition has been properly disclosed and is permitted by applicable law.

11. Monthly Subscriptions and Automatic Renewal

Certain Clessence bundle offers may include an automatically renewing subscription.

When you select an offer identified as a subscription and complete checkout, you authorize recurring charges to the payment method provided according to the subscription terms disclosed before purchase.

For a Monthly Refill subscription, your subscription renews approximately once every month until cancelled.

Your checkout will display applicable recurring purchase information. Shopify also displays a subscription agreement informing customers that they are purchasing an automatically renewing subscription.

By completing a subscription purchase, you authorize us and our payment providers to charge the recurring amount applicable to your subscription, together with applicable shipping and taxes, until the subscription is cancelled or otherwise ends.

12. Subscription Pricing

The first order price may include bundle discounts, introductory pricing, free gifts, or other promotional incentives.

Your recurring charge will be the recurring price disclosed as part of the subscription purchase and checkout experience, together with applicable shipping and taxes.

Customers should review the recurring amount and subscription frequency before completing checkout.

We will not intentionally enroll a customer in recurring billing without presenting the subscription as a recurring purchase.

13. Subscription Cancellation

Unless otherwise clearly disclosed before purchase, Clessence monthly subscriptions may be cancelled without a minimum long-term commitment.

Customers may cancel using any subscription-management option made available through their customer account or by contacting Clessence customer support.

Cancellation should be completed before the next scheduled renewal if you do not want another order processed.

Cancelling a subscription generally prevents future renewal orders. It does not automatically cancel or refund an order that has already been processed before the cancellation took effect.

Any additional rights provided under applicable law remain unaffected.

Shopify requires subscription customers to agree to the applicable cancellation terms during checkout.

14. Failed Subscription Payments

If a recurring payment cannot be processed, the subscription platform or payment provider may attempt to collect payment again according to its applicable procedures.

We may pause, cancel, or otherwise modify a subscription following repeated payment failures where permitted.

Customers are responsible for maintaining valid payment information for active subscriptions.

15. Third-Party Supplier and Fulfillment

Clessence works with third-party suppliers, manufacturers, logistics providers, and/or fulfillment partners in connection with certain products.

This may mean that products are shipped directly from a supplier or fulfillment location rather than from premises personally operated by Clessence.

The return address may also differ from the original shipping address.

Do not return a product to the sender address shown on the package unless Clessence instructs you to do so.

Customers must contact us first to obtain the appropriate return instructions and return destination.

Use of third-party suppliers does not eliminate any consumer rights that cannot legally be waived.

16. Shipping

We make reasonable efforts to process and arrange shipment of orders promptly.

Shipping and delivery estimates are estimates rather than guarantees unless we expressly state otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

• carrier delays;
• customs processing;
• weather;
• holidays;
• incorrect addresses;
• supplier delays;
• inventory availability; and
• international shipping restrictions.

Tracking information will be provided where available.

17. International Orders

Clessence may offer shipping to select countries or regions.

Available destinations will generally be shown during checkout.

Customers ordering internationally may be responsible for applicable:

• customs duties;
• import taxes;
• brokerage charges;
• local fees; or
• other government charges

unless the checkout or applicable offer expressly states that such charges are included.

Customers are responsible for ensuring that products ordered may legally be imported into their destination jurisdiction.

18. Returns

Eligible products may be returned within 30 days of delivery, subject to these Terms, our Return & Refund Policy, and applicable law.

Before returning any item, customers must contact Clessence and receive the appropriate return instructions.

Returns sent without authorization or to an incorrect location may be delayed or may not qualify for processing where permitted by law.

19. Return Shipping Costs

Unless the return results from an incorrect, damaged, or defective item, or applicable law requires otherwise:

customers are responsible for the cost of return shipping to the return address provided by Clessence.

Return shipping charges are non-refundable.

The designated return location may be a supplier or fulfillment facility and may differ from the address from which the package originally appeared to ship.

We recommend using a tracked shipping method.

Clessence cannot be responsible for return packages that are lost before being delivered to the designated return location, except where applicable law provides otherwise.

20. Return Condition

Because Clessence sells ingestible wellness products, opened or materially used products may be restricted from return for health, hygiene, or safety reasons where legally permitted.

Products returned for ordinary change-of-mind reasons should generally be:

• in their original condition;
• appropriately packaged;
• accompanied by the necessary order information; and
• returned according to the instructions provided.

These restrictions do not override mandatory legal rights relating to defective, incorrect, unsafe, or misrepresented products.

21. Refunds

Once an eligible return has been received and inspected, we will determine whether it qualifies for a refund under our policy and applicable law.

Approved refunds will generally be issued to the original payment method.

Banks and payment providers may require additional processing time after a refund has been initiated.

Original shipping costs and return shipping costs may be non-refundable unless otherwise stated or required by law.

22. Damaged, Defective, or Incorrect Orders

If you receive an incorrect, damaged, or defective product, contact Clessence promptly.

We may request:

• your order number;
• photographs;
• a description of the issue; and
• other reasonable information necessary to investigate the problem.

Where appropriate, we will provide a remedy consistent with our policies and applicable law.

Do not exceed the recommended amount unless directed by an appropriate healthcare professional.

If you experience an unexpected or concerning reaction, discontinue use and seek appropriate medical advice.

24. Allergies and Sensitivities

Ingredient sensitivities vary between individuals.

Customers with known allergies or sensitivities should review the complete ingredient and allergen information before use and consult a healthcare professional where appropriate.

Clessence should not be described as “allergen-free” unless that representation has been specifically verified and legally substantiated.

25. Product Authorization

Products will only be offered where we believe their sale is legally permitted.

Where Canadian natural health product rules apply, natural health products generally require authorization and an eight-digit Natural Product Number (NPN) or DIN-HM before being legally marketed in Canada.

Customers should refer to the physical product label for applicable authorization information.

26. Reviews and Testimonials

Customer reviews and testimonials represent individual experiences.

An individual review should not be interpreted as a guarantee that another customer will experience the same result.

Clessence does not authorize fabricated reviews or knowingly false testimonials.

We reserve the right to moderate content that is unlawful, abusive, fraudulent, misleading, irrelevant, or otherwise inappropriate, subject to applicable law.

27. Advertising and Product Claims

We make reasonable efforts to ensure that our advertisements and product descriptions accurately represent our products.

No statement should be interpreted beyond its reasonable meaning or beyond claims legally authorized for the applicable product.

Only health products authorized for sale by Health Canada may legally be advertised as health products in Canada, and advertising must not be false, misleading, or deceptive.

Unless otherwise stated, content appearing on the Clessence website—including branding, written content, product graphics, advertisements, page designs, and original photographs—is owned by Clessence or used with appropriate permission.

You may not reproduce, copy, commercially exploit, distribute, or modify protected content without authorization except where permitted by law.

This provision does not apply where prohibited by consumer-protection law.

These Terms do not waive any mandatory rights or remedies available to consumers under applicable law.

If any provision of these Terms conflicts with a mandatory consumer-protection requirement, the mandatory legal requirement will apply.

37. Governing Law

To the extent permitted by law, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

This provision does not deprive customers in another jurisdiction of mandatory consumer rights that legally apply to them.
